Article R716-7 of the French Intellectual Property Code

The Director General of the Institute shall rule on the application for invalidity or revocation in the light of all the written and oral observations submitted, if any, by the parties.

At any time during the proceedings, by express request:

1° The applicant for invalidity may waive one or more of the grounds invoked or limit the scope of his application to some of the goods or services invoked or referred to;

2° The applicant for revocation may limit the scope of his application to some of the goods or services referred to.

Le directeur général de l’Institut statue sur la demande en nullité ou en déchéance au vu de l’ensemble des observations écrites et orales présentées, le cas échéant, par les parties.

A tout moment de la procédure, par requête expresse :

1° Le demandeur en nullité peut renoncer à un ou plusieurs des motifs invoqués ou circonscrire la portée de sa demande à certains des produits ou services invoqués ou visés ;

2° Le demandeur en déchéance peut circonscrire la portée de sa demande à certains produits ou services visés.
