Article R717-8 of the French Intellectual Property Code

Any application for international registration or for registration subsequent to such registration submitted, under the Madrid Agreement of 14 April 1891 and the Madrid Protocol of 27 June 1989, for the visa of the National Institute of Industrial Property for transmission to the International Bureau, must be presented under the conditions laid down by the decision referred to in l’article R. 712-26.

The provisions of Article R. 712-11 are applicable to any application that does not meet the conditions set out in the previous paragraph. The date of referral to the National Institute of Industrial Property is the date on which the application was, where applicable, regularised.

Toute demande d’enregistrement international ou d’inscription postérieure à cet enregistrement soumise, en vertu de l’arrangement de Madrid du 14 avril 1891 et du Protocole de Madrid du 27 juin 1989, au visa de l’Institut national de la propriété industrielle pour transmission au bureau international, doit être présentée dans les conditions fixées par la décision mentionnée à l’article R. 712-26.

Les dispositions de l’article R. 712-11 sont applicables à toute demande ne répondant pas aux conditions prévues à l’alinéa précédent. La date de saisine de l’Institut national de la propriété industrielle est celle à laquelle la demande a, le cas échéant, été régularisée.
