Article R718-7 of the French Intellectual Property Code

Collective certification marks registered before the entry into force of decree no. 2019-1316 of 9 December 2019 remain governed by the provisions of articles R. 715-1 and R. 715-2 in their wording prior to that resulting from this decree. For a period of one year from the entry into force of the latter, the owner of such a mark may request the Institut national de la propriété industrielle to enter the following wording in the national register of marks: “collective certification mark”.

Collective marks filed prior to the entry into force of the same decree remain governed by the provisions of articles R. 715-1 and R. 715-2 in their wording prior to that resulting from this decree. For a period of one year from the entry into force of the decree, the owner of such a mark may request the Institut National de la Propriété Industrielle to enter in the National Register of Trademarks the following indication: “simple collective mark”.

Les marques collectives de certification déposées avant l’entrée en vigueur du décret n° 2019-1316 du 9 décembre 2019 demeurent régies par les dispositions des articles R. 715-1 et R. 715-2 dans leur rédaction antérieure à celle résultant de ce décret. Pendant un délai d’un an à compter de l’entrée en vigueur de ce dernier, le titulaire d’une telle marque peut demander à l’Institut national de la propriété industrielle de porter au registre national des marques la mention suivante : “ marque collective de certification ”.
