Article R*721-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The Minister of the Interior is competent to determine the country of removal in the event of compulsory enforcement in the following cases:
1° When the foreign national, present on French territory, is subject to an administrative ban on entry;
2° When he himself has issued the expulsion decision to which the foreign national is subject ; however, the prefect of the département and, in Paris, the prefect of the police are competent where the expulsion decision was issued by the Minister of the Interior before the entry into force of decree no. 97-24 of 13 January 1997 on the basis of the provisions of article 23 of order no. 45-2658 of 2 November 1945, now codified in article L. 631-1, and after completion of the formalities provided for in article 24 of the same order, now codified in article L. 632-1.

Article R*721-3

Le ministre de l’intérieur est compétent pour fixer le pays de renvoi en cas d’exécution d’office dans les cas suivants :
1° Lorsque l’étranger, présent sur le territoire français, fait l’objet d’une interdiction administrative du territoire ;
2° Lorsqu’il a lui-même édicté la décision d’expulsion dont l’étranger fait l’objet ; toutefois, le préfet de département et, à Paris, le préfet de police sont compétents lorsque la décision d’expulsion a été édictée par le ministre de l’intérieur avant l’entrée en vigueur du décret n° 97-24 du 13 janvier 1997 sur le fondement des dispositions de l’article 23 de l’ordonnance n° 45-2658 du 2 novembre 1945, désormais codifiées à l’article L. 631-1, et après accomplissement des formalités prévues par les dispositions de l’article 24 de la même ordonnance, désormais codifiées à l’article L. 632-1.
