Article R722-2 of the French Intellectual Property Code

The seizure, whether descriptive or real, provided for in Article L. 722-4 shall be ordered by the president of the judicial court with jurisdiction to hear the case on the merits.

The president may authorise the bailiff to make any useful findings with a view to establishing the origin, consistency and extent of the infringement of a geographical indication.

In order to ensure the protection of business secrecy, the president may ex officio order the temporary sequestration of the seized documents, under the conditions provided for in Article R. 153-1 of the Commercial Code.

Article R722-2

La saisie, descriptive ou réelle, prévue à l’article L. 722-4 est ordonnée par le président du tribunal judiciaire compétent pour connaître du fond.

Le président peut autoriser l’huissier à procéder à toute constatation utile en vue d’établir l’origine, la consistance et l’étendue de l’atteinte à une indication géographique.

Afin d’assurer la protection du secret des affaires, le président peut ordonner d’office le placement sous séquestre provisoire des pièces saisies, dans les conditions prévues à l’article R. 153-1 du code de commerce.
