Article R722-27 of the French Commercial code

The declaration of interests and any updates thereto shall be kept for a period of five years from the end of the duties for which they were submitted, at which time they shall be destroyed, with due regard for the confidentiality of the information contained therein. However, in the event of disciplinary or criminal proceedings based on a breach relating to the information contained in the declaration of interests or its update, the destruction of these declarations is suspended until the expiry of the period during which any appeals against the decision taken at the end of the disciplinary or criminal proceedings have been exhausted.

The declaration of interests and its update are kept until the expiry of a period of five years from the end of the duties in respect of which they were submitted.

La déclaration d’intérêts et l’actualisation de cette déclaration sont conservées jusqu’à l’expiration d’un délai de cinq ans à compter de la fin des fonctions au titre desquelles elles ont été remises. Elles sont alors détruites dans le respect de la confidentialité des éléments qu’elles contiennent.

Toutefois, en cas de poursuites disciplinaires ou pénales fondées sur un manquement en lien avec des éléments contenus dans la déclaration d’intérêts ou son actualisation, la destruction de ces déclarations est suspendue jusqu’à l’expiration du délai au terme duquel les voies de recours contre la décision éventuellement prise à l’issue de la procédure disciplinaire ou pénale engagée sont épuisées.
