Article R722-40 of the French Commercial code

In the event that the agreement provided for in article R. 722-31 of this code has not been concluded, the costs incurred shall be paid directly to the judge on presentation of the invoices paid by him.

The amount of fees covered by the State is limited by hourly ceilings set by joint order of the Keeper of the Seals, Minister of Justice and the Minister for the Budget.

Dans le cas où la convention prévue à l’article R. 722-31 du présent code n’a pas été conclue, la prise en charge des frais exposés est réglée directement au juge sur présentation des factures acquittées par lui.

Le montant de prise en charge des honoraires par l’Etat est limité par des plafonds horaires fixés par arrêté conjoint du garde des sceaux, ministre de la justice et du ministre chargé du budget.
