Appeals relating to the election of the president of the commercial court shall be lodged by written declaration filed with or delivered to the clerk’s office of the court of appeal within ten days of the vote. Appeals may only be lodged by serving consular judges of the commercial court and the public prosecutor. The president whose election is contested may validly be installed and carry out his duties until a final ruling has been made on the appeal.
The Court of Appeal shall rule within ten days of the matter being referred to it after summoning the appellant and the chairman whose election is contested to hear their explanations.
An appeal in cassation shall be lodged under the conditions laid down in articles 999 to 1008 of the Code of Civil Procedure. The time limit for appeal runs from the date of the judgment handed down by the Court of Appeal; it is counted under the conditions set out in Articles 641 and 642 of the Code of Civil Procedure.
