The election of the members of the commission mentioned in 3° of article L. 724-2 shall be decided by a majority of the votes cast. In the event of a tie, the oldest candidate is declared elected.
Voting is by postal ballot. Each president of the commercial court must write his ballot paper with the names of four of the candidates. Each commercial court president then places his ballot paper in an envelope marked “Election of the members of the National Disciplinary Commission of Commercial Court Judges”. After signing the envelope, indicating his full name and affixing the stamp of his court, he places it in a second sealed envelope, which he sends to the secretary of the Commission by 10 March at the latest.
The envelope is then signed by the president of the court.
