The commercial court clerk invested with a delegation mandate in accordance with the second paragraph of Article 27 of Order no. 2022-544 of 13 April 2022 relating to the ethics and discipline of ministerial officers:
1° Must not have been the perpetrator of acts contrary to honour and probity;
2° Refrains from exercising the delegated powers when the exercise of these powers has a link with:
-the court registry at which he works or has worked over the last three years as an employee, partner or holder of that office;
the company in which he exercises or holds shares;
-a relative or relative in the line of kin
-a relative or ally in the direct line, whatever the degree, or in the collateral line, up to and including the degree of uncle or nephew.
Without prejudice to the foregoing provisions, the delegatee who considers that he or she should defer because of links of interest with the individual situation in question shall refrain from exercising the delegated powers.
The delegation may be withdrawn at any time, in particular where there are reasons likely to call into question the delegatee’s impartiality or independence.
