Article R741-6 bis of the French Commercial code

The commercial court clerk invested with a delegation mandate in accordance with the second paragraph of Article 27 of Order no. 2022-544 of 13 April 2022 relating to the ethics and discipline of ministerial officers:

1° Must not have been the perpetrator of acts contrary to honour and probity;

2° Refrains from exercising the delegated powers when the exercise of these powers has a link with:

-the court registry at which he works or has worked over the last three years as an employee, partner or holder of that office;

the company in which he exercises or holds shares;

-a relative or relative in the line of kin
-a relative or ally in the direct line, whatever the degree, or in the collateral line, up to and including the degree of uncle or nephew.

Without prejudice to the foregoing provisions, the delegatee who considers that he or she should defer because of links of interest with the individual situation in question shall refrain from exercising the delegated powers.

The delegation may be withdrawn at any time, in particular where there are reasons likely to call into question the delegatee’s impartiality or independence.

Article R741-6 bis

Le greffier de tribunal de commerce investi d’un mandat de délégation conformément au deuxième alinéa de l’article 27 de l’ordonnance n° 2022-544 du 13 avril 2022 relative à la déontologie et à la discipline des officiers ministériels :

1° Ne doit pas avoir été l’auteur de faits contraires à l’honneur et à la probité ;

2° S’abstient d’exercer les attributions déléguées lorsque leurs exercices présentent un lien avec :

-le greffe au sein duquel il exerce ou a exercé au cours des trois dernières années, en tant que salarié, associé ou titulaire de cet office ;

-la société dans laquelle il exerce ou détient des actions ou parts sociales ;

-un parent ou allié en ligne directe, quel que soit le degré, ou en ligne collatérale, jusqu’au degré d’oncle ou de neveu inclus.

Sans préjudice des dispositions qui précèdent, le délégataire qui estime devoir se déporter en raison des liens d’intérêts avec la situation individuelle en cause s’abstient d’exercer les attributions déléguées.

La délégation peut être retirée à tout moment, notamment lorsqu’il existe des raisons susceptibles de mettre en cause l’impartialité ou l’indépendance du délégataire.
