Article R742-21 of the French Commercial code

Each application must be sent to the Minister for Justice by tele-procedure on the website of the Ministry of Justice.

The application must be accompanied by an undertaking to pay the compensation set jointly by the Minister for Justice and the Minister for the Budget. Where the candidate is required to take out a loan, the application must be accompanied by information enabling the candidate’s financial resources to be assessed in the light of the commitments entered into.

The Minister for Justice will arrange for an investigation to be carried out into the good character and professional abilities of the candidates. The office of the Conseil national des greffiers des tribunaux de commerce shall provide it, within twenty days of its request, with any information it has on these two elements.

Chaque candidature est adressée au garde des sceaux, ministre de la justice, par téléprocédure sur le site internet du ministère de la justice.

La candidature doit être accompagnée d’un engagement à payer l’indemnité fixée conjointement par le garde des sceaux, ministre de la justice, et le ministre chargé du budget. Lorsque le candidat doit contracter un emprunt, la demande est accompagnée des éléments permettant d’apprécier ses possibilités financières au regard des engagements contractés.

Le garde des sceaux, ministre de la justice, fait procéder à une enquête sur l’honorabilité et les capacités professionnelles des candidats. Le bureau du Conseil national des greffiers des tribunaux de commerce lui communique, dans les vingt jours suivant sa demande, toute information dont il dispose sur ces deux éléments.
