Article R742-21 of the French Labour Code

In the event of non reconciliation, recourse may be made to arbitration under the conditions set out in Title II (Chapter V) of Book V.

Within a period of one clear day, the arbitrator must deposit the minutes of his award and the documents submitted by the parties with the Ministry of the Merchant Navy or the Directorate of Maritime Affairs, depending on the place where the minutes of the non-conciliation were drawn up.

Where applicable, the costs of this deposit shall be borne by the parties.

Copies of the award are also filed in accordance with the conditions and time limits set out in article R. 742-3.

En cas de non-conciliation il peut être recouru à un arbitrage dans les conditions prévues par le titre II (chap V) du livre V.

Dans le délai d’un jour franc, l’arbitre doit déposer la minute de sa sentence et les pièces remises par les parties au ministère de la marine marchande ou à la direction des affaires maritimes, suivant le lieu où aura été dressé le procès-verbal de non-conciliation.

Le cas échéant, les frais de ce dépôt sont à la charge des parties.

Des copies de la sentence sont, en outre, déposées dans les conditions et les délais prévus à l’article R. 742-3.
