The competitive examination for access to the profession of commercial court clerk is held before a national jury, which chooses the subject of the tests.
The jury is made up of two magistrates from the judiciary and a commercial court clerk, either in active service or honorary. The chair is held by the most senior magistrate in the highest grade.
The chair and members of the examination panel are appointed by order of the Minister of Justice for a period of three years, renewable once, after consulting the board of the Conseil national des greffiers des tribunaux de commerce in the case of the commercial court clerk. An equal number of alternates are appointed under the same conditions.
Specialised examiners may be appointed by order of the Minister for Justice to assist the jury.
The jury draws up a list of candidates admitted in the order in which they passed the tests and sends it to the Minister for Justice and to the President of the National Council of Commercial Court Clerks. It is published in the Journal officiel de la République française in the month following this transmission.
The selection board may, under the conditions laid down by order of the Minister of Justice, not fill all the places offered.
