Article R7423-1 of the French Labour Code

The industrial tribunal hears disputes relating to the remuneration of home workers and, in particular, rectifies accounts showing rates lower than the minimum rate defined in articles L. 7422-4 and L. 7422-5.
The difference between the salary actually paid and the salary that should have been paid is paid to the worker. No account shall be taken of any compensation that the employer may be ordered to pay.

Article R7423-1

Le conseil de prud’hommes connaît les litiges relatifs à la rémunération des travailleurs à domicile et redresse notamment les comptes faisant ressortir des tarifs inférieurs au tarif minimum défini aux articles L. 7422-4 et L. 7422-5.
La différence constatée entre le salaire effectivement versé et celui qui aurait dû l’être est payée au travailleur. Il ne doit pas être tenu compte de l’indemnité à laquelle le donneur d’ouvrage peut être condamné.
