Without prejudice to the provisions of Article R. 213-29 of the Code of Judicial Organisation, each commercial court registry is inspected at least once every four years. It may also be subject to occasional unannounced inspections covering a particular area of the clerk’s professional activity or all of it.
Each inspection is ordered by the Minister of Justice, either on his own initiative or at the request of the president of the commercial court or the president of the Conseil national des greffiers des tribunaux de commerce. It is conducted by the public prosecutor. It is carried out by one or more inspectors appointed by the Minister of Justice, from among active commercial court clerks or among honorary clerks who have ceased their activity for less than three years.
The clerks thus appointed are chosen from a list comprising at least forty names, drawn up before the beginning of each year by the board of the National Council of Commercial Court Clerks.
Before the beginning of each year, the board of the National Council shall also send to the Minister of Justice, the list of clerks proposed for periodic inspection during the following year.
