Article R743-116 of the French Commercial code

For the application of article R. 743-79, if the successors of members who die in the case provided for in Article R. 743-67, or the partners in the other cases of dissolution of the company with the exception of that resulting from its dismissal, have unanimously chosen a candidate for the office, from among the persons who have applied pursuant to article R. 742-27-1 and under the conditions provided for in article R. 743-44, the liquidator shall exercise the right of presentation in his favour.

Pour l’application de l’article R. 743-79, si les ayants droit des associés décédés dans le cas prévu à l’article R. 743-67, ou les associés dans les autres cas de dissolution de la société à l’exception de celui résultant de sa destitution, ont choisi à l’unanimité un candidat à l’office, parmi les personnes ayant candidaté en application de l’article R. 742-27-1 et dans les conditions prévues à l’article R. 743-44, le liquidateur exerce le droit de présentation en sa faveur.
