Article R743-139-3 of the French Commercial code

The salaried commercial court clerk invested with a mandate in the Conseil national des greffiers des tribunaux de commerce may not participate in deliberations or votes on disciplinary matters concerning the titular clerk of the office or the associated clerks exercising their functions within the titular company of the office in which he is employed.

The latter may not, when invested with such a mandate, participate in deliberations or votes on disciplinary matters concerning a salaried clerk of the office.

Le greffier de tribunal de commerce salarié investi d’un mandat au Conseil national des greffiers des tribunaux de commerce ne peut pas participer aux délibérations ni aux votes sur des questions disciplinaires concernant le greffier titulaire de l’office ou les greffiers associés exerçant leurs fonctions au sein de la société titulaire de l’office dans lequel il est employé.

Ceux-ci ne peuvent, lorsqu’ils sont investis d’un tel mandat, participer aux délibérations et aux votes sur des questions disciplinaires concernant un greffier salarié de l’office.
