Any plan to recruit a salaried court clerk is brought to the attention of the Minister for Justice, the Keeper of the Seals, by tele-procedure on the website of the Ministry of Justice. The Minister of Justice will publicise this announcement by means of an order specifying the closing date for applications. The deadline for candidates to submit their applications may not be less than thirty days from publication of the order in the Journal officiel de la République française. Applications must be sent by registered letter with acknowledgement of receipt, or by any other means that ensures receipt, to the Registrar of the Commercial Court.
When a winner of the competition provided for in article R. 742-6-1, the highest-ranked candidate is recruited from among the candidates from the same promotion.
The employment contract is drawn up in writing, subject to the suspensive condition that the employee is appointed as a commercial court clerk and is sworn in. The condition is deemed to have been fulfilled on the date of the swearing-in.
It may not include any clause likely to limit the employee’s freedom of subsequent establishment or to affect his independence. It specifies the conditions of his remuneration.
A copy of the employment contract is sent, as soon as it is signed, to the President of the Conseil national des greffiers des tribunaux de commerce; the same applies to any amendment to this contract.
