Article R743-15 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the first president of the court of appeal or his delegate considers rejecting a statement of appeal in application of the second paragraph of article L. 743-23, he shall by any means obtain the parties’ observations on the absence of new factual or legal circumstances since the administrative detention or its renewal, or on the inoperative nature of the elements provided by the foreign national.

Lorsque le premier président de la cour d’appel ou son délégué envisage de rejeter une déclaration d’appel en application du second alinéa de l’article L. 743-23, il recueille par tout moyen les observations des parties sur l’absence de circonstance nouvelle de fait ou de droit depuis le placement en rétention administrative ou son renouvellement, ou sur le caractère inopérant des éléments fournis par l’étranger.
