The clerks of the commercial courts may, before proceeding with the acts of their department, require from the party requesting the acts or formalities a sufficient advance for the payment of the costs, emoluments, disbursements and remuneration relating to these acts or formalities. The provision shall include, where applicable, the amount of fees due to the National Institute of Industrial Property for maintaining the National Register of Companies.
In the case of the procedures referred to in Article L. 123-33 and relating to registrations, amending registrations and removals occurring within the Trade and Companies Register, as well as the Special Register of Commercial Agents and the Special Register of Sole Proprietorships with Limited Liability, and in the case of the procedures for the electronic filing of accounting documents mentioned in Article R. 123-111, this advance is paid by the requesting party to the single body mentioned in Article R. 123-1, under the conditions set out in Article R. 123-8.
