Article R743-41 of the French Commercial code

The registration of the company in the Trade and Companies Register is governed by articles R. 123-31 et seq, subject to the following provisions:

An ampliation of the appointment order provided for in article R. 743-31 is sent by the partners to the clerk of the court where the application for registration in the Trade and Companies Register was filed; on receipt of this ampliation, the clerk of the court registers the company and informs the Minister of Justice and the Principal State Prosecutor of the Court of Appeal within whose jurisdiction the company’s registered office is located.

L’immatriculation de la société au registre du commerce et des sociétés est régie par les articles R. 123-31 et suivants, sous réserve des dispositions ci-après :

Une ampliation de l’arrêté de nomination prévu à l’article R. 743-31 est adressée par les associés au greffe du tribunal où a été déposée la demande d’immatriculation au registre du commerce et des sociétés ; au reçu de cette ampliation, le greffier procède à l’immatriculation et en informe le garde des sceaux, ministre de la justice, ainsi que le procureur général près la cour d’appel dans le ressort de laquelle est fixé le siège de la société.
