Article R752-12 of the French Commercial code

If the file is complete, the commission secretariat informs the applicant of the date and registration number of the application and the date by which the decision must be notified to the applicant. The applicant is also informed that, if no decision has been notified before this date, the authorisation will be deemed to have been granted.

If the file is incomplete, the commission secretariat invites the applicant, by registered letter with acknowledgement of receipt or, in the case provided for in article R. 752-8, by electronic mail, to provide the missing documents.

Failing receipt by the applicant, within fifteen clear days of receipt of the application, of a request to produce a missing document, the application is deemed to be complete.

The time limit for examining the application runs from receipt by the commission secretariat of a complete application. As soon as the application is received, the prefect, in application of I of article L. 751-2, informs, by any means, the mayors of the municipalities bordering the municipality of establishment and included in the catchment area as referred to and defined in articles L. 751-2 and R. 752-3.

Si le dossier est complet, le secrétariat de la commission fait connaître au demandeur la date et le numéro d’enregistrement de sa demande et la date avant laquelle la décision doit lui être notifiée. Le demandeur est en outre informé que, si aucune décision ne lui a été notifiée avant cette date, l’autorisation sera réputée accordée.

Si le dossier est incomplet, le secrétariat de la commission invite le demandeur, par lettre recommandée avec demande d’avis de réception ou, dans le cas prévu à l’article R. 752-8, par courrier électronique, à fournir les pièces manquantes.

A défaut de réception par le demandeur, dans le délai de quinze jours francs suivant la réception du dossier, d’une demande de production d’une pièce manquante, le dossier est réputé complet.

Le délai d’instruction de la demande court à compter de la réception par le secrétariat de la commission d’un dossier complet. Dès cette réception le préfet, en application du I de l’article L. 751-2, informe, par tout moyen, les maires des communes limitrophes de la commune d’implantation incluses dans la zone de chalandise telle que visée et définie aux articles L. 751-2 et R. 752-3.
