Within fifteen clear days of the registration of an application for authorisation to operate a business at the secretariat of the departmental commission for a project mentioned in the first or second paragraph of article L. 752-1-2, the Prefect of the département in which the project is located may request, in the event that the authorisation procedure is suspended:
a) For projects mentioned in the first paragraph of article L. 752-1-2, the opinion of the president of the local authority of the municipality in which the project is located and the opinion of each of the mayors of the municipalities that are signatories to the territorial regeneration operation agreement;
b) For the projects mentioned in the second paragraph of article L. 752-1-2, the opinion of the president of the public establishment for inter-municipal cooperation with its own tax system that is a signatory to the agreement for the revitalisation of the area, each of the mayors of the municipalities that are signatories to this same agreement, the mayor of the municipality in which the project is located and, if the latter is a member of a public establishment for inter-municipal cooperation with its own tax system that borders the public establishment for inter-municipal cooperation that is a signatory, the opinion of its president.
The prefect’s request for an opinion includes:
a) For the projects mentioned in the first paragraph of article L. 752-1-2, a statement of the characteristics of the project and the data specific to the sectors of intervention defined in the agreement included in the trading zone, such as to justify suspension of the procedure before the departmental commission;
b) For the projects mentioned in the second paragraph of article L. 752-1-2, a statement of the characteristics of the project and the objectives pursued by the revitalisation operation likely to be seriously compromised by the project, such as to justify suspension of the procedure before the departmental committee.
The sending of the request for an opinion gives rise to a fifteen-day response period, at the end of which the Prefect has seven days to issue a suspension order, if necessary. If the requests for an opinion are not sent on the same day, the period allowed for the Prefect to issue a suspension order, if applicable, runs from the expiry of the latest response period.
