When an application for authorisation to operate a business has been submitted to the departmental commission for a project mentioned in the first paragraph of article L. 752-1-2, the president of the local authority of the municipality in which the project is located and each of the mayors of the municipalities that are signatories to the territorial regeneration operation agreement may jointly submit a request to the prefect of the department in which the project is located to suspend the registration and examination of this application.
When an application for authorisation to operate a business has been submitted to the departmental commission for a project mentioned in the second paragraph of article L. 752-1-2, the president of the public inter-municipal cooperation body with its own tax system that is a signatory to the territorial revitalisation operation agreement, each of the mayors of the municipalities that are signatories to this agreement, the mayor of the municipality in which the project is located and, if this municipality is a member of a public inter-municipal cooperation body with its own tax system that borders on the public inter-municipal cooperation body that is a signatory, its president may jointly submit a request to the prefect of the department in which the project is located to suspend the registration and examination of this application.
The request for suspension includes:
a) For the projects mentioned in the first paragraph of article L. 752-1-2, a statement of the characteristics of the project and the data specific to the sectors of intervention defined in the agreement included in the trading zone, such as to justify the suspension of the procedure before the departmental commission;
b) For the projects mentioned in the second paragraph of article L. 752-1-2, a statement of the characteristics of the project and the objectives pursued by the revitalisation operation likely to be seriously compromised by the project, such as to justify suspension of the procedure before the departmental commission for commercial development.
The request for suspension must reach the Prefect no later than twenty-one clear days after the registration of the application for authorisation to operate a business by the secretariat of the departmental commission. If the application for suspension is sent to the Prefect in several separate mailings, the latest of these must reach the Prefect within this twenty-one day period.
If the Prefect decides to suspend the commercial development consent procedure for the project, he has fifteen days from receipt of the complete application for suspension to issue his order.
The failure of the prefect to act on this request within the time allowed does not give rise to a tacit decision to suspend.
