Article R752-29-3 of the French Commercial code

When an application for authorisation to operate a business has been submitted to the departmental commission for a project mentioned in the first paragraph of article L. 752-1-2, the president of the local authority of the municipality in which the project is located and each of the mayors of the municipalities that are signatories to the territorial regeneration operation agreement may jointly submit a request to the prefect of the department in which the project is located to suspend the registration and examination of this application.

When an application for authorisation to operate a business has been submitted to the departmental commission for a project mentioned in the second paragraph of article L. 752-1-2, the president of the public inter-municipal cooperation body with its own tax system that is a signatory to the territorial revitalisation operation agreement, each of the mayors of the municipalities that are signatories to this agreement, the mayor of the municipality in which the project is located and, if this municipality is a member of a public inter-municipal cooperation body with its own tax system that borders on the public inter-municipal cooperation body that is a signatory, its president may jointly submit a request to the prefect of the department in which the project is located to suspend the registration and examination of this application.

The request for suspension includes:

a) For the projects mentioned in the first paragraph of article L. 752-1-2, a statement of the characteristics of the project and the data specific to the sectors of intervention defined in the agreement included in the trading zone, such as to justify the suspension of the procedure before the departmental commission;

b) For the projects mentioned in the second paragraph of article L. 752-1-2, a statement of the characteristics of the project and the objectives pursued by the revitalisation operation likely to be seriously compromised by the project, such as to justify suspension of the procedure before the departmental commission for commercial development.

The request for suspension must reach the Prefect no later than twenty-one clear days after the registration of the application for authorisation to operate a business by the secretariat of the departmental commission. If the application for suspension is sent to the Prefect in several separate mailings, the latest of these must reach the Prefect within this twenty-one day period.

If the Prefect decides to suspend the commercial development consent procedure for the project, he has fifteen days from receipt of the complete application for suspension to issue his order.

The failure of the prefect to act on this request within the time allowed does not give rise to a tacit decision to suspend.

Lorsqu’une demande d’autorisation d’exploitation commerciale a été déposée auprès de la commission départementale pour un projet mentionné au premier alinéa de l’article L. 752-1-2, le président de l’établissement public de coopération intercommunale à fiscalité propre dont est membre la commune d’implantation et chacun des maires des communes signataires de la convention d’opération de revitalisation de territoire peuvent saisir conjointement le préfet du département d’implantation du projet d’une demande de suspension de l’enregistrement et de l’examen de cette demande.

Lorsqu’une demande d’autorisation d’exploitation commerciale a été déposée auprès de la commission départementale pour un projet mentionné au deuxième alinéa de l’article L. 752-1-2, le président de l’établissement public de coopération intercommunale à fiscalité propre signataire de la convention d’opération de revitalisation de territoire, chacun des maires des communes signataires de cette convention, le maire de la commune d’implantation du projet et, si celle-ci est membre d’un établissement public de coopération intercommunale à fiscalité propre limitrophe de l’établissement public de coopération intercommunale signataire, son président peuvent saisir conjointement le préfet du département d’implantation du projet d’une demande de suspension de l’enregistrement et de l’examen de cette demande.

La demande de suspension comporte :

a) Pour les projets mentionnés au premier alinéa de l’article L. 752-1-2, un exposé des caractéristiques du projet et des données propres aux secteurs d’intervention définis dans la convention inclus dans la zone de chalandise, de nature à justifier la suspension de la procédure devant la commission départementale ;

b) Pour les projets mentionnés au deuxième alinéa de l’article L. 752-1-2, un exposé des caractéristiques du projet et des objectifs poursuivis par l’opération de revitalisation susceptibles d’être gravement compromis par le projet, de nature à justifier la suspension de la procédure devant la commission départementale d’aménagement commercial.

La demande de suspension doit parvenir au préfet au plus tard vingt-et-un jours francs après l’enregistrement, par le secrétariat de la commission départementale, de la demande d’autorisation d’exploitation commerciale. Si la demande de suspension est adressée au préfet en plusieurs envois distincts, le plus tardif d’entre eux doit parvenir à ce dernier dans ce délai de vingt-et-un jours.

Si le préfet décide de suspendre la procédure d’autorisation d’exploitation commerciale du projet, il a quinze jours, à compter de la réception de la demande complète de suspension, pour prendre son arrêté.

L’absence de suite donnée à cette demande par le préfet dans le délai qui lui est imparti ne fait pas naître une décision tacite de suspension.
