Article R752-33 of the French Commercial code

When, after the expiry of a period of two months following its receipt by the Chairman of the National Commission, a claimant withdraws his appeal against the decision or opinion of the Departmental Commission, the National Commission may nevertheless, in accordance with the rules laid down in the first paragraph of Article R. 752-38, decide to rule on the draft submitted to it. It shall inform the parties of its decision at least ten days before the meeting at which the draft will be examined.

Lorsqu’après l’expiration d’un délai de deux mois suivant sa réception par le président de la commission nationale, un requérant retire son recours contre la décision ou l’avis de la commission départementale, la commission nationale peut néanmoins, selon les règles prévues au premier alinéa de l’article R. 752-38, décider de se prononcer sur le projet qui lui est soumis. Elle informe les parties de sa décision dix jours au moins avant la réunion au cours de laquelle le projet sera examiné.
