The new application must include, in addition to the opinion or decision of the National Commission on the project, the updated commercial development authorisation application file.
If the application is not accepted, it must be accompanied by a summary of the adjustments made to the project.
On pain of inadmissibility, the applicant has five days from the date of referral to the National Commission to notify the new application to the prefect of the department in which the project is located and, if applicable, to each applicant who has previously referred the same project to the National Commission. This notification includes the new application file and a copy of the summary statement mentioned in the previous paragraph. The Prefect informs the members of the Commission Départementale d’Aménagement Commercial of this new application without delay.
Where the project requires planning permission, the five-day period runs, subject to the same sanction of inadmissibility, from the date of registration of the new application at the town hall, the receipt issued by the mayor acting as proof.
