Article R752-43-6 of the French Commercial code

The provisions of article R. 752-35 are applicable. However, the documents mentioned in the third to seventh paragraphs of this article are replaced by the following documents:

<1° The unfavourable opinion or refusal decision issued at the previous meeting of the National Commission;

2° The new application;

3° Any note drawn up by the local investigating departments on the project resulting from the new application;

4° The report of the National Commission’s investigating department on the new application.

Les dispositions de l’article R. 752-35 sont applicables. Toutefois, les pièces du dossier mentionnées aux troisième à septième alinéas de cet article sont remplacées par les pièces suivantes :

1° L’avis défavorable ou la décision de refus rendu lors de la précédente réunion de la Commission nationale ;

2° La nouvelle demande ;

3° La note éventuellement établie par les services instructeurs locaux sur le projet issu de la nouvelle demande ;

4° Le rapport du service instructeur de la Commission nationale sur la nouvelle demande.
