Article R752-44-1 of the French Commercial code

The certificate of conformity provided for in Article L. 752-23 for the projects mentioned in article R. 752-44 :

1° For projects not requiring planning permission:

a) The commercial operating authorisation;

b) Proof of the date of its notification pursuant to article R. 752-19, R. 752-39 or R. 752-43-9;

2° For projects subject to a commercial development permit requiring a building permit:

a) The favourable opinion of the commercial development commission;

b) The order granting the building permit valid as a commercial development permit;

The certificate of compliance includes the references of the prefectoral order authorising the body that drew it up.

Article R752-44-1

Sont joints au certificat de conformité prévu à l’article L. 752-23 pour les projets mentionnés à l’article R. 752-44 :

1° Pour les projets ne nécessitant pas de permis de construire :

a) L’autorisation d’exploitation commerciale ;

b) Le justificatif de la date de sa notification en application de l’article R. 752-19, R. 752-39 ou R. 752-43-9 ;

2° Pour les projets soumis à autorisation d’exploitation commerciale nécessitant un permis de construire :

a) L’avis favorable de la commission d’aménagement commercial ;

b) L’arrêté accordant le permis de construire valant autorisation d’exploitation commerciale ;

Le certificat de conformité comporte les références de l’arrêté préfectoral d’habilitation de l’organisme qui l’a établi.
