Article R752-44-7 of the French Commercial code

If it is shown to be impossible to appoint an authorised body in the department where the business is located, the prefect of that department, on receipt of an express detailed request, may exceptionally authorise the beneficiary of the commercial operating authorisation to choose a body from the list drawn up in a neighbouring department belonging to the same administrative region.

En cas d’impossibilité avérée de mandater un organisme habilité dans le département d’implantation, le préfet de ce département, saisi d’une demande expresse circonstanciée, peut exceptionnellement autoriser le bénéficiaire de l’autorisation d’exploitation commerciale à choisir un organisme dans la liste établie dans un département limitrophe appartenant à la même région administrative.
