Article R752-45 of the French Commercial code

When a commercial facility subject to authorisation for commercial operation ceases to be operated for commercial purposes, the owner of the site where the facility is located shall notify the date on which commercial operation ceases to the prefect of the département of the commune where the facility is located.

A commercial facility that is not open to the public is not operated for commercial purposes.

The three-year period provided for in article L. 752-1 runs from the date of cessation of operation.

Lorsqu’un équipement commercial soumis à autorisation d’exploitation commerciale cesse d’être exploité à des fins commerciales, le propriétaire du site d’implantation notifie la date de la cessation d’exploitation commerciale au préfet du département de la commune d’implantation.


Un équipement commercial qui n’est pas ouvert au public n’est pas exploité à des fins commerciales.

Le délai de trois ans prévu à l’article L. 752-1 court à compter de la date de cessation d’exploitation.
