Article R752 of the French Commercial code

Commercial development authorisation may not be issued for a commercial development project the implementation of which results in the artificial development of the land.

For the purposes of V of Article L. 752-6, a commercial development project is deemed to result in soil artificialisation if its implementation results, on the cadastral parcel or parcels on which it is located, in an increase in the area of artificialised land, within the meaning of ninth paragraph of Article L. 101-2-1 of the French Planning Code, compared with the state of these same plots on 23 August 2021.

L’autorisation d’exploitation commerciale ne peut être délivrée pour un projet d’équipement commercial dont la réalisation engendre une artificialisation des sols.


Pour l’application du V de l’article L. 752-6, est considéré comme engendrant une artificialisation des sols un projet d’équipement commercial dont la réalisation engendre, sur la ou les parcelles cadastrales sur lesquelles il prend place, une augmentation des superficies des terrains artificialisés, au sens du neuvième alinéa de l’article L. 101-2-1 du code de l’urbanisme, par rapport à l’état de ces mêmes parcelles à la date du 23 août 2021.
