Article R753-9 of the French Monetary and Financial Code

I. – Subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

“II. – For the application of I:

“1° For leasing transactions involving movable property, registrations made pursuant to Article L. 313-10 shall lapse after five years, unless renewed ;

“1° bis In Article R. 313-4, the reference to Articles R. 521-1 et seq. of the French Commercial Code is replaced by a reference to the equivalent provisions applicable locally;

“2° In article R. 313-12, the words “in accordance with the procedures laid down for contracts of the same nature governed by articles 28 and 37 of amended decree no. 55-22 of 4 January 1955 reforming land registration” are deleted;”.

Article R753-9

I. – Sont applicables en Polynésie française, sous réserve des adaptations prévues au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

“II. – Pour l’application du I :

“1° Pour les opérations de crédit-bail en matière mobilière, les inscriptions prises en vertu de l’article L. 313-10 se prescrivent par cinq ans, sauf renouvellement ;

“1° bis A l’article R. 313-4, la référence aux articles R. 521-1 et suivants du code de commerce est remplacée par une référence aux dispositions équivalentes applicables localement ;

“2° A l’article R. 313-12, les mots : “suivant les modalités fixées pour les contrats de même nature régis par les articles 28 et 37 du décret n° 55-22 du 4 janvier 1955 modifié portant réforme de la publicité foncière” sont supprimés ;“
