Article R760-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

By way of derogation from article R. 732-2, the administrative authority competent to assign a foreign national to residence is the Minister of the Interior when, at the time the decision is made:
1° The foreign national is in a department of mainland France and the chosen place of assignment is located in Guadeloupe, French Guiana, Martinique, Reunion Island, Mayotte, Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon ;
2° The foreign national is in Guadeloupe, French Guiana, Martinique, La Réunion, Mayotte, Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon and the chosen place of assignment is in a department of mainland France;
3° The foreign national is in Guadeloupe, French Guiana, Martinique, La Réunion or Mayotte and the chosen place of assignment is located in Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon;
4° The foreign national is in Saint-Barthélemy, Saint-Martin or Saint-Pierre-et-Miquelon and the chosen place of assignment is located in Guadeloupe, French Guiana, Martinique, La Réunion or Mayotte.

Article R760-1

Par dérogation à l’article R. 732-2, l’autorité administrative compétente pour assigner un étranger à résidence est le ministre de l’intérieur lorsqu’au moment du prononcé de la décision :
1° L’étranger se trouve dans un département de la France métropolitaine et que le lieu d’assignation choisi est situé en Guadeloupe, en Guyane, en Martinique, à La Réunion, à Mayotte, à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon ;
2° L’étranger se trouve en Guadeloupe, en Guyane, en Martinique, à La Réunion, à Mayotte, à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon et que le lieu d’assignation choisi est situé dans un département de la France métropolitaine ;
3° L’étranger se trouve en Guadeloupe, en Guyane, en Martinique, à La Réunion, à Mayotte et que le lieu d’assignation choisi est situé à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon ;
4° L’étranger se trouve à Saint-Barthélemy, à Saint-Martin ou à Saint-Pierre-et-Miquelon et que le lieu d’assignation choisi est situé en Guadeloupe, en Guyane, en Martinique, à La Réunion ou à Mayotte.
