Article R761-12-3 of the French Commercial code

The period for examining the application for authorisation is three months. It runs from the date of the discharge or the notice of receipt or the electronic acknowledgement of receipt provided for in article R. 761-12 or, in the event of implementation of the provisions of the second paragraph of Article R. 761-12-2, from receipt of the last document completing the file.

The deadline may be extended by one month if justified by the complexity of the application or if the applicant has applied the provisions of article R. 761-12-5. In this case, the prefect shall notify the applicant by letter stating the reasons before the initial investigation period expires.

Le délai d’instruction de la demande d’autorisation est de trois mois. Il court à compter du jour de la décharge ou de l’avis de réception ou de l’accusé de réception électronique prévu à l’article R. 761-12 ou, en cas de mise en œuvre des dispositions du second alinéa de l’article R. 761-12-2, à compter de la réception de la dernière pièce complétant le dossier.

Le délai peut être prorogé d’un mois si la complexité du dossier le justifie ou si le demandeur a fait application des dispositions de l’article R. 761-12-5. Dans ce cas, le préfet en avise le demandeur par lettre motivée avant l’expiration du délai d’instruction initial.
