Article R762-5 of the French Commercial code

The operator of a registered exhibition centre shall send, for each calendar year, the declaration of the annual programme of commercial events as defined in article R. 762-4 held in its park, to the prefect of the département in which the park is located, before 1st October of the year preceding the commercial events included in this programme.

The park operator declares the main characteristics of each commercial event, which it obtains from its organiser. The list of these characteristics is defined by an order of the minister responsible for trade. Where the event has been held previously, its quantified characteristics are certified under conditions set by order of the minister responsible for trade.

The declaration of the annual programme is sent by the exhibition park operator electronically.

It gives rise to the issue of an electronic acknowledgement of receipt. The prefect shall ensure that the transmission is carried out securely, in accordance with Article 1366 of the Civil Code. The park operator electronically sends a copy of this receipt to the organisers of the events covered by the annual declaration.

L’exploitant d’un parc d’exposition enregistré adresse, pour chaque année civile, la déclaration du programme annuel des manifestations commerciales telles que définies à l’article R. 762-4 se tenant dans son parc, au préfet du département d’implantation de ce parc, avant le 1er octobre de l’année précédant la tenue des manifestations commerciales inscrites dans ce programme.

L’exploitant du parc déclare les principales caractéristiques de chaque manifestation commerciale, qu’il recueille auprès de son organisateur. La liste de ces caractéristiques est définie par un arrêté du ministre chargé du commerce. Lorsque la manifestation s’est tenue précédemment, ses caractéristiques chiffrées sont certifiées dans des conditions fixées par arrêté du ministre chargé du commerce.

La déclaration du programme annuel est transmise par l’exploitant du parc d’exposition par voie électronique.

Elle donne lieu à la délivrance d’un accusé de réception, par voie électronique. Le préfet veille à ce que la transmission soit assurée de manière sécurisée, conformément à l’article 1366 du code civil. L’exploitant du parc adresse par voie électronique une copie de ce récépissé aux organisateurs des manifestations faisant l’objet de la déclaration annuelle.
