Article R774-29 of the French Monetary and Financial Code

I. – Subject to the adaptations provided for in II, the provisions of the articles mentioned in the left-hand column of the table below shall apply in French Polynesia, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° In article R. 546-1, references to the body mentioned in article L. 512-1 of the Insurance Code and to the register of persons mentioned in I of article L. 546-1 are replaced by locally applicable provisions having the same purpose;
2° In article R. 546-2, the second paragraph of I and the second sentence of II are deleted;
3° In article R. 546-3, the second sentence of VI is deleted;
4° In article R. 546-5, after the words: “secure telecommunications”, the end of the article is replaced by the following provisions: “or, for the persons mentioned in article L. 545-1 from New Caledonia, French Polynesia and the Wallis and Futuna Islands, at the registry of the court of first instance mentioned in article 874 of the code of criminal procedure”.

I. – Sont applicables en Polynésie française, sous réserve des adaptations prévues au II, les dispositions des articles mentionnés dans la colonne de gauche du tableau ci-après, dans leur rédaction indiquée dans la colonne de droite du même tableau :

II. – Pour l’application du I :
1° A l’article R. 546-1, les références à l’organisme mentionné à l’article L. 512-1 du code des assurances et au registre des personnes mentionnées au I de l’article L. 546-1 sont remplacées par les dispositions applicables localement ayant le même objet ;
2° A l’article R. 546-2, le second alinéa du I et la deuxième phrase du II sont supprimés ;
3° A l’article R. 546-3, la deuxième phrase du VI est supprimée ;
4° A l’article R. 546-5, après les mots : « télécommunication sécurisée », la fin de l’article est remplacée par les dispositions suivantes : « ou, pour les personnes mentionnées à l’article L. 545-1 originaires de Nouvelle-Calédonie, de Polynésie française et des îles Wallis et Futuna, auprès du greffe du tribunal de première instance mentionné à l’article 874 du code de procédure pénale ».
