Article R784-11 of the French Monetary and Financial Code

I. – Are applicable in the Wallis and Futuna Islands, subject to the adaptations mentioned in II, the provisions of the articles mentioned in the left-hand column of the table below, in the wording indicated in the right-hand column of the same table:

II. – For the application of I:
1° The references to the European Banking Authority and the resolution authorities of the other Member States of the European Union shall not apply;
2° In the first paragraph of Article R. 613-18, after the words “and the Banque de France”, the following words shall be added: “and the Institut d’émission d’outre-mer”;
3° In Articles R. 613-14, R. 613-15, R. 613-19, R. 613-22, the references to Decree No. 85-1388 of 27 December 1985 shall be deleted; 4° In the first paragraph of Article R. 613-18, after the words “and the Banque de France”, the following words shall be added: “and the Institut d’émission d’outre-mer”. 613-22, the references to decree no. 85-1388 of 27 December 1985 are deleted;
4° In article R. 613-28, the b of the A of the 5° is worded as follows:
” b) At a variable rate equal, on the date of the issue or borrowing, to a reference index determined on the basis of the rate at which banks can, on the money market, lend funds to other banks or to agents other than banks or borrow funds from them”.

II. – Pour l’application du I :
1° Les références à l’Autorité bancaire européenne et aux autorités de résolution des autres Etats membres de l’Union européenne ne sont pas applicables ;
2° Au premier alinéa de l’article R. 613-18, après les mots : « et de la Banque de France », sont ajoutés les mots : « ainsi que de l’Institut d’émission d’outre-mer » ;
3° Aux articles R. 613-14, R. 613-15, R. 613-19, R. 613-22, les références au décret n° 85-1388 du 27 décembre 1985 sont supprimées ;
4° A l’article R. 613-28, le b du A du 5° est ainsi rédigé :
« b) A un taux variable égal, à la date de l’émission ou de l’emprunt, à un indice de référence déterminé sur la base du taux auquel les banques peuvent, sur le marché monétaire, prêter des fonds à d’autres banques ou à des agents autres que des banques ou leur emprunter des fonds ».
