Article R8124-3 of the French Labour Code

Each member of staff assigned to the Public Labour Inspectorate ensures, in the light of his or her job and responsibilities, that the provisions of the Labour Code and other legal provisions relating to the labour system are applied, as well as the stipulations of collective labour agreements meeting the conditions set out in Book II of Part Two of this Code and in particular the provisions and stipulations ensuring respect for the fundamental rights and freedoms of workers and human beings. In carrying out its duties, it contributes to the implementation of the constitutional principles that are particularly necessary in our time, as proclaimed by the Preamble to the 1946 Constitution.

Chaque agent affecté au sein du service public de l’inspection du travail veille, compte tenu de son emploi et de ses attributions, à l’application des dispositions du code du travail et des autres dispositions légales relatives au régime du travail, ainsi qu’aux stipulations des conventions et accords collectifs de travail répondant aux conditions fixées au livre II de la deuxième partie du ce code et notamment des dispositions et stipulations assurant le respect des droits et libertés fondamentaux du travailleur et de la personne humaine. Dans l’exercice de ses missions, il contribue à la mise en œuvre des principes constitutionnels particulièrement nécessaires à notre temps proclamés par le Préambule de la Constitution de 1946.
