Article R835-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book to French Polynesia:
1° References to the Prefect are replaced by references to the High Commissioner of the Republic in French Polynesia;
2° In Article R. 810-1, the reference to Article R. 812-1 is deleted;
3° Article R. 821-2 reads as follows:

“Art. R. 821-2.-The services competent to carry out the controls referred to in the second paragraph of Article L. 821-7 are the territorial formation of the national gendarmerie based in the community or, in the absence of such services, the customs services under the authority of the State”;

4° Article R. 821-5 reads as follows:

“Art. R. 821-5.-The official report noting the breach by the transport company is signed:
” 1° By the official entrusted with the duties of head of station or by the official designated by him, holding the rank of lieutenant or higher, if the control is carried out by officials of the national police force ;
” 2° By the official vested with the duties of head of post or by the official designated by him, holding the grade of controller or higher, if the control is carried out by customs officials;
” 3° Or by the gendarmerie serviceman vested with the duties of brigade commander or his deputy if the control is carried out by national gendarmerie servicemen. 5° In article R. 822-2, the words: “in breach of article L. 8251-1 of the Labour Code” are replaced by the words: “in breach of locally applicable provisions relating to the employment of foreign labour”; 6° In article R. 822-4, the words: “in application of article L. 8271-17 of the Labour Code” are replaced by the words: “in breach of locally applicable provisions relating to the employment of foreign labour”; 7° In article R. 822-5, the words: “in application of article L. 8271-17 of the Labour Code” are replaced by the words: “in breach of locally applicable provisions relating to the employment of foreign labour”. 8271-17 of the Labour Code, the Director General of the French Office for Immigration and Integration” are replaced by the words: “in application of locally applicable provisions relating to the employment of foreign workers, the High Commissioner of the Republic in French Polynesia”;
7° In article R. 822-5:
a) The words: “the Director General of the French Office for Immigration and Integration” and the words: “the Minister” are replaced by the words: “the High Commissioner of the Republic in French Polynesia”;
b) After the words: “The debt is recovered by the”, the words: “Director of Public Finances in French Polynesia,” are inserted.

Article R835-3

Pour l’application du présent livre à la Polynésie française :
1° Les références au préfet sont remplacées par la référence au haut-commissaire de la République en Polynésie française ;
2° A l’article R. 810-1, la référence à l’article R. 812-1 est supprimée ;
3° L’article R. 821-2 est ainsi rédigé :

” Art. R. 821-2.-Les services compétents pour procéder aux contrôles mentionnés au second alinéa de l’article L. 821-7 sont la formation territoriale de la gendarmerie nationale implantée dans la collectivité ou, en l’absence de tels services, les services des douanes relevant de l’Etat ” ;

4° L’article R. 821-5 est ainsi rédigé :

” Art. R. 821-5.-Le procès-verbal constatant le manquement de l’entreprise de transport est signé :

5° A l’article R. 822-2, les mots : ” en violation de l’article L. 8251-1 du code du travail ” sont remplacés par les mots : ” en violation des dispositions applicables localement relatives à l’emploi de la main d’œuvre étrangère ” ;
6° A l’article R. 822-4, les mots : ” en application de l’article L. 8271-17 du code du travail, le directeur général de l’Office français de l’immigration et de l’intégration ” sont remplacés par les mots : ” en application des dispositions applicables localement relatives à l’emploi de la main d’œuvre étrangère, le haut-commissaire de la République en Polynésie française ” ;
7° A l’article R. 822-5 :
a) Les mots : ” le directeur général de l’Office français de l’immigration et de l’intégration ” et les mots : ” le ministre ” sont remplacés par les mots : ” le haut-commissaire de la République en Polynésie française ” ;
