Title XXIII: The use of means of telecommunication during proceedings

For the application of the provisions of Article 706-71, audio or audiovisual means of telecommunication may be used. However, for presentation for the purposes of extending police custody or judicial detention, only the use of audiovisual means of telecommunication is authorised.

During the investigation, the use of a means of telecommunication pursuant to the provisions of the second paragraph of Article 706-71 shall be decided by the public prosecutor.

The technical characteristics of the means of telecommunication used must ensure faithful, loyal and confidential retransmission with regard to third parties. When the provisions of the third paragraph of Article 706-71 are applied in the course of an information, the interpreter’s oath provided for in the second paragraph of article 102 shall be taken, by the investigating judge or by the judicial police officer conducting the hearing of the person, via the means of telecommunication.
