Single chapter: Provisions applicable to the regulatory and supervisory authorities

Any manager of a person referred to in I and II of article L. 612-2 who fails to produce a recovery plan prescribed in accordance with the provisions of article R. 612-30 or fails to implement it within the conditions and deadlines laid down is liable to a fifth-class fine. A repeat offence under this article is punishable in accordance with article 132-11 of the Criminal Code.

Any manager of a person referred to in I and 3° of II of Article L. 612-2 who fails to make the transfer referred to in the last paragraph of Article R. 612-32 is liable to a fifth-class fine. Repetition of the offence provided for in this article is punishable in accordance with article 132-11 of the Criminal Code.

For the purposes of applying the penalties listed in this Title, the following are deemed to be company directors: the chairman and managing director, the chairman, the directors, the managing directors, the deputy managing directors, the directors, the members of the supervisory board and the management board, the managers, and any de facto director of a French company, and, in the case of a foreign company, the managing director or…
