Section 1: Rules common to leases of houses and rural property.

The lessee is liable for any damage or loss that occurs through the act of persons in his house or his subtenants.

If the lease was made without writing, one of the parties may only give notice to the other by observing the time limits set by the use of the premises.

The lease ceases ipso jure on expiry of the term fixed, where it has been made in writing, without it being necessary to give notice.

If, on the expiry of the written leases, the lessee remains and is left in possession, a new lease is entered into, the effect of which is governed by the article relating to tenancies entered into without writing.

Where notice has been served, the lessee, even though he has continued to enjoy the lease, cannot invoke tacit renewal.

In the case of the two preceding articles, the security given for the lease does not extend to the obligations resulting from the extension.

The contract of lease is terminated by the loss of the thing leased, and by the respective failure of the lessor and lessee to fulfil their commitments.

The contract of lease is not terminated by the death of the lessor or the lessee.

If the lessor sells the leased property, the purchaser may not evict the farmer, sharecropper or lessee who has an authentic lease or one whose date is certain. He may, however, evict the lessee of non-rural property if he has reserved this right for himself in the lease contract. .
