Section 2: Supervision, inspection and discipline.

The provisions of articles R. 811-40 to R. 811-42-1 relating to the supervision and inspection of court-appointed administrators are applicable to court-appointed agents and persons designated under the conditions of the first paragraph of II of article L. 812-2.

The provisions of articles R. 811-57 to R. 811-59 relating to the enforcement of disciplinary sanctions and provisional suspension measures and relating to provisional administration are applicable to judicial representatives. However, for the application of Article R. 811-58, the provisional administrator is chosen from among the persons registered on the list of judicial representatives or from among those who meet the conditions for registration.

The government commissioner at the Commission nationale d’inscription et de discipline des administrateurs judiciaires et des mandataires judiciaires ensures that disciplinary sanctions are enforced. He informs the public prosecutors at the appeal courts of the final decisions pronouncing a temporary or permanent ban or ordering a provisional suspension measure; the latter bring these decisions to the attention of the courts within their jurisdiction. .
