CHAPTER I: Economic aid

The State is responsible for the conduct of economic and social policy and the defence of employment. However, subject to respect for the freedom of trade and industry and the principle of equality of citizens before the law, the municipality may intervene in economic and social matters under the conditions set out in this chapter and in article L. 2253-1.

When the purpose of the local authority’s intervention is to promote economic development, it may grant aid under the conditions set out in Title I of Book V of Part One and in article L. 2253-1.

When private initiative is lacking or insufficient to ensure the creation or maintenance of a service required to meet the needs of the population in a rural area or in a municipality comprising one or more priority neighbourhoods for urban policy, the municipality may entrust responsibility for creating or managing it to an association governed by the loi du 1er juillet 1901 relative au contrat d’association or to any other…

Municipalities and their groupings may award operating grants to the local structures of representative trade union organisations under conditions laid down by decree in the Conseil d’Etat. The organisations thus subsidised are required to submit a report to the town council detailing the use of the subsidy.

The municipality may award subsidies to existing companies whose purpose is to operate cinemas under conditions laid down by decree in the Conseil d’Etat. These subsidies may only be awarded to establishments which, regardless of the number of screens, achieve a weekly average of less than 7,500 admissions or which are classified as arthouse under conditions set by decree.
