Subsection III: Register matters.

The provisions of this sub-section apply to the keeping of registers by the judicial court and the local court in the cases provided for by local legislation, subject to the special provisions for the register of associations set out in sub-section IV.

Any registration must mention the day on which it is made and be signed by the court clerk. The registration is notified to the person who requested it, by the issue of a digital registration certificate if the request was created and transmitted electronically. .

Where registration is subject to the prior resolution of a dispute, the court may defer ruling on the application for registration.

Requests for registration may be taken in minutes by the registrar.

Applications for registration may also be created and transmitted electronically, using technical procedures that must guarantee, under conditions specific to each register, the reliability of the identification of the author, the integrity of the documents sent, the security and confidentiality of exchanges, the preservation of transmissions made and make it possible to establish with certainty the date of sending and that of receipt by the recipient.

Where a declaration required for registration has been authenticated or certified by a notary, the notary is entitled to request registration in the name of the person required to make the declaration.

Where an entry has been registered even though it was inadmissible because an essential condition was missing, the court in charge of the register may strike it off ex officio. It must inform the interested person of the proposed striking off and allow him a suitable period in which to make his objections. An order rejecting such objections may only be appealed immediately.

In the case provided for in article 37 of the local civil code, the association’s management shall be heard or invited to present its written observations before the court orders the convening of the general meeting. The order may only be subject to an immediate appeal.
