Chapter I: General provisions.

I.-Any person whose fertility is likely to be impaired as a result of medical treatment or whose fertility is likely to be prematurely impaired may benefit from the collection or removal and preservation of their gametes or germ tissue with a view to the subsequent performance, for their benefit, of medically assisted procreation, with a view to preserving or restoring their fertility or with a view to restoring hormonal function….

The import and export of gametes or germ tissue derived from the human body are subject to authorisation issued by the Agence de la biomédecine. They are exclusively intended to enable the pursuit of a parental project through medically assisted procreation or the restoration of the applicant’s fertility or hormonal function, to the exclusion of any commercial purpose. I.-A person of full age who meets the age conditions set by a decree of the Conseil d’Etat, issued after consultation with the Agence de la biomédecine, may benefit from the collection, retrieval and storage of his or her gametes with a view to subsequent medically assisted procreation on his or her behalf under the conditions set out in this chapter, following medical supervision by the multidisciplinary clinical biology team….

The detailed rules for the application of this chapter are determined by decree in the Conseil d’Etat, and in particular : 1° The procedures for applying Article L. 2141-6 and in particular the activities subject to the authorisation provided for in the last paragraph of this Article; 2° The health safety rules to which the implementation of medically assisted procreation is subject; 3° The conditions for authorising the import and…
