Chapter I: Health-related children's homes.

The establishments referred to in this chapter are health establishments and as such are subject to the provisions of Book I of Part Six of this Code.

Medical children’s homes are permanent or temporary establishments designed to receive, on medical certificate, children or adolescents aged between three and seventeen, with a view to providing them with follow-up care or rehabilitation. Children’s homes of a medical nature do not include public or private educational climatic establishments where the cost of the children’s stay may be covered by health insurance bodies.

Children from establishments where delinquent minors, minors at risk or minors with sensory, motor, intellectual, character or behavioural disorders are usually educated may not be admitted to children’s homes.

The conditions relating to personnel and, where necessary, the procedures for applying the provisions of this chapter shall be determined by decree in the Conseil d’Etat.
