Chapter III: Suppression of public drunkenness and protection of minors.

Judicial police officers and law enforcement officers are responsible for investigating and recording, each in the territory in which they carry out their duties, the offences provided for in article L. 3336-4 and in this chapter; they draw up reports to establish these offences.

Reports of offences under article L. 3336-4 and this chapter shall be forwarded to the Public Prosecutor within three days, including the day on which the offence is recorded.

The sale of alcoholic beverages to minors is punishable by a fine of €7,500. The offer of these drinks free of charge to minors, in public houses and all shops or public places, or the offer, free of charge or for consideration, to a minor of any object directly encouraging excessive consumption of alcohol under the conditions set out in article L. 3342-1 is punishable by the same penalty. Article 227-19 of the French Penal Code makes it an offence to directly incite a minor to consume excessive amounts of alcohol or to habitually consume alcohol.

In the cases provided for in this chapter, the accused may prove that he was misled as to the age of the minor, the status or age of the person accompanying him or the condition of the patient. If he proves this, no penalty will be applicable on this count.

In the event of conviction for the offences provided for in this chapter, the Criminal Court may order that its judgment be displayed in such number of copies and in such places as it shall specify.
