Dispensing gases for medical use at home without being authorised to do so under the provisions of article L. 4211-5 is punishable by a fine of €3,750.

The preparation or supply of allergens, specially prepared for a single individual, without the authorisation mentioned in article L. 4211-6 is punishable by a fine of 3,750 euros.

The following is punishable by a fine of 3,750 euros for a qualified herbalist: 1° Holding for sale or selling medicinal plants or parts of medicinal plants, whether indigenous or acclimatised, mentioned in article L. 5132-7 ; 2° To supply the public with medicinal plants or parts of medicinal plants, whether indigenous or acclimatised, in the form of a mixture prepared in advance, in the absence of authorisation granted by…

The sale to the public of medicinal plants, whether mixed or not, in all public places, in private homes and in shops other than pharmacies and herbalists’ shops, is punishable by a fine of €3,750.

Distributing or making available to the public unused medicinal products for human use collected from the public is punishable by two years’ imprisonment and a fine of €30,000.

In all the cases mentioned in the articles of this chapter, a repeat offence is punishable by three months’ imprisonment and a fine of 7,500 euros. Natural persons guilty of an offence under this chapter are also liable to the additional penalty of temporary or permanent closure of the establishment.
