Chapter IV: Smoking products made from plants other than tobacco

Products made from plants, aromatic plants or fruit, which do not contain tobacco and can be consumed by means of a combustion process, are considered to be plant-based smoking products other than tobacco.

An ingredient is considered to be an additive as well as any other substance or element present in a plant-based smoking product other than tobacco, including the paper, filter, ink, capsules and glues.

I.-The labelling of unit packets, any outer packaging and the herbal smoking product other than tobacco itself may not include any element or device that : 1° Contributes to the promotion of the product or encourages its consumption by giving an erroneous impression as to the characteristics, health effects, risks or emissions of the product; labels shall not include any information on the nicotine, tar or carbon monoxide content of…

All unit packs and outer packaging of plant-based smoking products other than tobacco carry a health warning in accordance with the conditions laid down by an order of the Minister for Health.

Before any non-tobacco plant-based smoking product is placed on the market, manufacturers and importers of such products must send a declaration of the ingredients used, by brand and type of product, to the public body designated by order.

A decree in the Conseil d’Etat shall determine the conditions of application of this chapter, in particular the content of the declaration, the procedures for transmitting and updating it, the nature of the information that is made public and the procedures for making it public.
